The Ohio Division of Real Estate fall 2018 newsletter is now available. As an Ohio real estate license holder, you know that you must stay current on real estate license laws and changes and this is NOT an option. Ohio real estate license holders have a new responsibility

Ohio real estate license holders must now report suspected elder abuse.Ohio Revised Code section 5101.63 states that as of September 2018, Ohio real estate license holders are now "mandatory reporters” of potential adult abuse, exploitation, and neglect. You can report suspected abuse by calling 1-855-OHIOAPS. You can also report to your county department of job and family services. Remember, elder abuse reports are confidential and not a public record.

From July 1, 2016, through June 30, 2017, a total of 16,579 reports of abuse, neglect, and exploitation were received by county departments of job and family services for adults 18 years of age and older. Of the 16,579 reports, 16,241 were reports for adults age 60 and older.

Social Media Advertising

Social media is a great way to reach your customer/client base, however, you have to make sure you do not violate advertising regulations. The current edition of the Division's newsletter features a section on social media advertising.

Common social media non-compliance issues are:

  • identifying a franchise name, but not including the affiliated brokerage by name
  • posting a property for sale on a personal/business account, however, not properly obtaining consent
  • from an authorized party and/or properly identifying the listing brokerage
  • posts with improper name identification, as in how the name appears on a license
  • failing to include agent ownership of a property
  • failure to remove and/or update outdated posts.
