Legislative Updates

Two bills were recently passed by the Illinois legislature that impacts Illinois real estate continuing education students.

House Bill 5210

Branch Office License: Eliminates the branch office license for real estate brokerages.
Business Entity, Ownership and Control: Modernizes the forms of business entity, and also clarifies the ownership and control requirements.
Payment of Commissions: Allows Sponsoring Brokers to pay commissions directly, for the maximum tax benefit, to an unlicensed corporation and also limited liability company (LLC) wholly owned by a real estate broker affiliated with the real estate brokerage firm.

Senate Bill 3036

Advisory Board Service: This bill establishes uniformity in term length and limits for the four DRE related professional advisory boards including The Auction Advisory Board, The Community Association Manager Licensing and Disciplinary Board, The Real Estate Administration and Disciplinary Board, and also The Real Estate Appraisal Administration and Disciplinary Board.
